Usher wins again.

After R&B singer Usher’s son, Usher Raymond V, 5, nearly drowned on Monday in a swimming pool at his father’s home, Tameka Raymond filed for emergency custody of their two sons.

While Usher V recovers in the hospital, his parents were in the courtroom, once again, battling for custody of him and his younger brother, Naviyd.

The Fulton County Superior Court judge presiding over the emergency hearing, Judge John Goger, decided there was no reason to change the status of the custody case.

“This was an accident that could happen to anyone with adult supervision,” Usher’s attorney, John Mayoue, told the court. “He wants to be at his son’s side at the hospital. He doesn’t want to be here today.”

Usher’s aunt Rena called 911 while two contractors who were working on the home performed CPR.

Tameka blasted Usher in the courtroom after stating: “My son basically had died.” She also said that Usher did not tell her about the accident for an hour after it happened, and he said the boy had a cut on his arm, only later mentioning him being stuck in the pool drain. She also made claims that it’s often that Usher doesn’t answer her emails or phone calls about her sons. “I don’t know where my children are. I don’t know who my children are with,” she said in court. “He doesn’t confer to me regarding anything.”

The judge warned Usher, “You would be well-advised to keep your former spouse informed about your whereabouts and who is taking care of the kids.”

Usher was originally awarded primary custody of the boys in 2012 after a lengthy court battle after the couples bitter divorce.
