Walmart reaches settlement with the children of comedian killed in crash that injured Tracy Morgan

The children of late comedian James McNair, who was killed in the June 2014 accident that also injured 30 Rock star Tracy Morgan, have reached a settlement with Walmart.

The retail giant has agreed to pay McNair’s children a reported $10 million to be distributed in monthly increments. The kids, 19-year-old Denita and 26-year-old Jamel, have opted to put aside a portion of the settlement for monthly payments that start at $3,000 and continue for the rest of their lives.


McNair was the only fatality of the collision when Walmart truck driver Kevin Roper crashed into the back of the limo bus carrying McNair, Morgan and other comedians after a show in Delaware.

A federal judge recently ruled that Morgan’s lawsuit against Roper and Walmart can proceed. Roper had attempted to delay the proceedings until a verdict was reached in his criminal trial.


“We deeply regret the loss of Mr. McNair as a result of the accident. Walmart worked closely with his family to ensure their well-being,” said a spokesman. “Walmart will continue to work to conclude all of the remaining issues and we’re committed to doing what’s right.”

Morgan has accused Walmart of a number of infractions, including failing to prevent driver fatigue, not maintaining collision-avoidance systems in their trucks, and trying to employ stall tactics to avoid answering claims that their negligence was in part responsible for the accident.
