Halle Berry and her ex, Gabriel Aubry, have been engaged in a nasty custody battle over their daughter Nahla, for the better part of a year. And after several wins and losses on both sides, Berry may just win the war, now that it’s been deemed that she’s the better parent.
According to TMZ, the custody evaluator, who is a psychologist, has performed extensive interviews with Berry, Aubry and others. And sources say that the evaluator has turned in a report to the judge, claiming Berry is the better parent.
The evaluation reportedly questions Aubry’s ability to care for his daughter. While there’s no doubt in the evaluator’s mind that Aubrey loves his daughter and she loves him, the report raises concerns about Aubrey’s emotional issues and raises doubts about his ability to be responsible for Nahla.
Berry, whom recently became engaged to French actor Olivier Martinez, plans to move to Paris with Martinez and wants to bring Nahla along, which Aubry strongly disapproves of.
The judge will decide the custody arrangement later this month and under California law, the judge cannot question Berry’s plans to move. The judge must accept as fact that Berry is moving and decide if it’s in the best interest of Nahla to be with Berry full-time or with Aubry.
But, considering the custody evaluation report, it seems like Berry will win custody of Nahla and make her move to Paris. And though Aubry will likely get visitation rights, his time with Nahla will be considerably lessened when she’s 5,000 miles across the sea.
Hopefully, Berry and Aubry will be able to work out their differences and maintain a positive presence in their daughter’s life.
