Frank Ocean’s father, Calvin Cooksey, landed himself in the public spotlight in September when he filed a massive $142 million defamation suit against Russell Simmons, saying that Simmons’ site, Global Grind, branded him a “deadbeat dad” and cost him nine figures in future income. Unfortunately for Cooksey, in November he lost his court battle. But it looks like Cooksey isn’t giving up the fight yet because he’s trying, once again, to take Simmons to court.
As previously reported, Cooksey was already at a major disadvantage going into his first battle with Simmons. Court documents revealed that Cooksey was unemployed and only living off a social security disability income of $779.66 a month, forcing him to beg the court to waive his court fees.
In the end, though, Cooksey lost after a judge threw out the case entirely, claiming that Cooksey didn’t provide enough evidence to prove that the case should even be heard in New York.
But according to TheJasmineBrand.com, Cooksey is at it again because in December he went back to court and demanded that the court throw out the order dismissing his case. Cooksey claims that the original judge misused his discretion when dismissing the lawsuit for allegedly being filed in the wrong state. Cooksey explains that Simmons and his company are both in New York, which gave him the right to sue him in the state. Cooksey is demanding that the court allow him a hearing to correct their mistake and get his case back on track.
We’ll wait to see how this turns out, but something tells us that Cooksey is going to walk away empty-handed, once again.
