A man who was captured on video kicking an elderly woman claims that he was a victim. On March 10, Marc Gomez was on a New York City train when he got into a confrontation with a 78-year-old woman.
At some point, the confrontation became violent and Gomez, 36, allegedly kicked the elderly woman in the face and head, causing bleeding, swelling to her face. She was treated at a local hospital and later released.
The video of the incident eventually went viral.
Authorities used social media to search for the suspect. On March 23, police arrested Gomez, who works as a cook.
During a court hearing following the vicious attack, Gomez defended his action by saying the homeless woman was lying across the seats of the subway car and wanted other passengers to move. His court-appointed attorney told the judge that the woman threatened to stab him with a knife.
The woman allegedly has mental issues and was known to threaten people with a knife, according to a former neighbor who spoke with the New York Post.
Gomez, 36, was charged with multiple counts of assault and harassment. His bail was set at $30,000 bond, $15,000 cash.
