Costa, who initially identified Barnave as his shooter, has since refused to cooperate with prosecutors. He says, “We feel the same way: Everything was an accident. We feel they should get out of the way and let us be.”

“I stuck my hand out the window. I heard the gun go off. I did not even realize that I hit him,” Barnave admits in a handwritten statement made the day of the shooting. Barnave accused Costa of trying to punch her through the car window during a fight over their joint checking account.

Barnave, who maintains her innocence faces 25 years in prison. Here’s her defense: “He had his mouth wired shut and was on all kinds of drugs,” she said, speaking about the accusation he made while hospitalized. “The cops lied.”

The couple plans to marry.
