South Africa South Africa’s journey toward marriage equality began thanks to the landmark case of the Minister of Home Affairs v. Fourie. In 2005, the Constitutional Court ruled that the existing marriage laws violated the equality clause of the Bill of Rights, and the nation legalized same-sex marriage with the 2006 Civil Union Act.
