DOMA and Prop 8 Were Struck Down

In June, after months of debate, the Supreme Court of the United States (SCOTUS) ruled that the Defense of Marriage Act (DOMA) is unconstitutional. SCOTUS also ruled 5-4 that there is “no standing” in the earlier Prop 8 case, Hollingsworth v. Perry, in which Prop 8 was challenged as a violation of the Due Process and Equal Protection Clauses of the Fourteenth Amendment to the United States Constitution. SCOTUS deemed that the trial judge’s decision ruling Prop 8 unconstitutional back in February will be recognized.
