Can Black people get away with police checkpoint challenges?

There has been a viral increase of videos on social media sites of interactions with police and drivers.


During these encounters the drivers know their rights, refuse to answer questions and challenge the officers to state the reason for stopping them. For the vast majority of the videos, the police officers involved are either confused about the law or allow the driver to proceed unmolested.

However, in these videos the drivers are predominately white and interacting with a White police officer.


The outcome is not the same for a Black person who exercises these legal rights. In numerous videos, Black drivers and passengers are brutalized by police or suffer broken car windows.

But you do not even have to be a driver to be a victim of police abuse. The death of unarmed man Eric Garner has proven this fact.
