A transgender woman in El Monte, Calif., has filed a federal civil rights and assault lawsuit against an unnamed El Monte police officer and the El Monte Police Department, claiming that the officer forced her to perform oral sex on him and then raped her.
According to the Los Angeles Times, the woman, who used the pseudonym “Jane Roe” in court documents, claims that on Oct. 23, 2012, she was walking to her friend’s house between 4 a.m. and 6 a.m. when she was stopped by an officer and ordered to lean into his police cruiser.
“Because she feared for her safety if she refused, [she] leaned forward and [the officer] groped her breasts,” the suit says, according to NBC. “He then asked [her] if she was ‘a nasty she-male.’ [She] responded that she was transsexual.”
Roe claims that the officer then ordered her to walk into an alley and then into a secluded parking lot where he forced her to perform oral sex on him before raping her on the trunk of his car as he called her demeaning names.
Afterward, the officer threw his condom on the ground, which Roe later retrieved as evidence. A DNA test is now being conducted on the semen and investigators are looking for other evidence as well.
The officer has been placed on leave but not arrested for the alleged crime.The El Monte police released the following statement about the lawsuit: “These allegations are very disturbing and clearly not representative of the expectations we have for the men and women who serve the El Monte Police Department. We take any allegation against our Police Department tor individual police officers very seriously because we hold our officers to the highest standard.”
