Eric Garner is the father of 1-year-old, daughter of his live-in girlfriend
Yes. He’s the father. The late Eric Garner, 43, who died in the hands of NYPD after he struggled to breathe while in a chokehold, and was a 400-pound asthma sufferer, is the confirmed father of one-year-old daughter Legacy. Eric has four biological children with his widow Esaw Garner, ages 15 to 25.
Legacy’s mother is Jewell Miller; she was Eric’s girlfriend and they were living together at the time of his death. There is an ongoing federal probe investigating his death.The medical examiner ruled Garner’s death a homicide and found a chokehold contributed to it.
Eric was captured on cellphone video yelling “I can’t breathe” 11 times while in a chokehold. The family’s lawyer, Jonathan Moore, is preparing a wrongful death suit against the police officers involved in Garner’s death.
The tot is in line for the largest share of any payout the Garner family gets from the city.
“As far as her being accepted into our family; that’ll never happen,” Esaw told the Daily News when asked about the baby. “We know that’s her baby and fine, that’s what she’s entitled to.”
Legacy’s mother is pleased it was confirmed her daughter will be one of the beneficiaries of Garner’s estate along with his four other children.
She said, “They knew she was his daughter but they didn’t want the public to know so they could keep up the image of the happily married husband and wife together which was the farthest thing from the truth… I think it was a public relations thing… And Esaw is just money hungry.”
