The rape trial of NBA player Derrick rose is taking a turn that may lead to a mistrial. Rose testified yesterday that the woman who is accusing him of rape was playing with a sex toy when he entered the bedroom. According to Rose, “She was laying on her back playing with a vibrator. It looked pink to me.”
This statement caused the lawyer for the accused to state in cross-examination ” I thought you told the jury on Friday you were color-blind?” To which Rose responded, “There are different kinds of color-blind. I’m brown and red color-blind … I know pink when I see it.”
Rose is accused of taking part in a gang rape of a 30-year-old woman with whom he has had multiple encounters with before. The woman claims she was allegedly drugged at Rose’s Beverly Hills mansion in August of 2015 and then later raped at her apartment while she was passed out. However, Rose insists that the woman invited two of his friends to have sex with her. According to him, she stated that they [should] go “one at a time.”
Rose testified that the accuser initiated sex with him by playing with his genitals. The pair had sex and according to Rose his NBA training kicked in after the encounter. “In my profession, they teach us right when we enter the NBA, if you can’t flush it, take your condom with you. In this profession, you have to be very careful with what you do with your condoms. … There was no way I was going to leave a condom — you never know what people will do,” he said. “I didn’t feel comfortable leaving the condom at her place,”
According to Rose, he received this training during a rookie transition program he attended in Orlando, Florida.
Rose said he became suspicious that he was being setup after receiving a series of text messages. Some of the messages appeared to have been withheld by the plaintiff in the $21.5 million federal lawsuit against Rose. The messages include a text where the accuser was upset that Rose didn’t have sex with a female friend she brought along. The text reads, “She was mad at me babe why u have me bring a b—- and u ain’t fina f— her.” The woman further asks Rose to deposit money in her account for a cab ride and the cost of a Munkey Barz sex belt that was used.
Because of questions as to when the texts were entered into evidence, the judge in the case is now considering a mistrial.
