“Mr. Miller maintains his innocence and we are diligently working with his legal defense team to free him, but In the meantime, we are monitoring the conditions at Elayn Hunt and are considering taking legal action. We stand with Mr. Miller and everyone who is incarcerated who are in fear of losing their lives due to the pandemic and inhumanity of the correctional system. We demand that the Department of Corrections act immediately,” the lawyers also added in the statement.
New Orleans’ NBC station WDSU Channel 6 News reports that members of C-Murder’s family also claim that the Jefferson Parish district attorney withheld documents and evidence that could prove his innocence. A jury voted 10-2 on Aug. 11, 2009, to convict him in the death of Steven Thomas, who was shot and killed at Platinum Club in Harvey, Louisiana, in 2002.
The U.S. Supreme Court has ruled non-unanimous jury verdicts are unconstitutional, but the high court ruled the decision doesn’t apply retroactively to his case. A post on the ruling is also posted on C-Murder’s Instagram that states more than 1,500 people are wrongfully incarcerated under the “illegal 10/2 verdict.”
